Registering the ending of a civil partnership in the civil registry in the Netherlands

Have you had your civil partnership ended by a lawyer or notary? Then they will register the final order (Akte ontbinding van geregistreerd partnerschap) with the civil registry (burgerlijke stand). Have you had your civil partnership ended by a court? Then the court will have the final order registered with the civil registry.

Ending a civil partnership outside of the courts

Your lawyer or notary sends the final order to the civil registry for registration. This is done within 3 months.

Ending a civil partnership by a judge in court

If a judge ends your civil partnership, registration with the civil registry follows within 6 months.

The final order should be registered with the registry office of the municipality where you formed your civil partnership. You must do this within 3 months if the final order is issued by a lawyer or notary, 6 months if issued by a court. Only then is your civil partnership legally ended.

A marriage or registered partnership can be dissolved through divorce or termination of partnership registration. Your lawyer usually ensures that the documents are sent to the municipality for registration of the divorce or termination of partnership registration. If you want to report the registration or termination yourself, you can only contact us by appointment.

Divorce

A marriage can be dissolved by divorce. A divorce requires the intervention of a court. You need a lawyer for this. After the judge's decision, the lawyer notifies the municipality where the marriage took place. The divorce is final if the decision of the court is entered in the registers of civil status within six months.

Termination of registered partnership

A registered partnership can be dissolved without the intervention of a court. This is only possible if both partners agree and they do not have joint minor children. The termination of a registered partnership then takes place through an agreement with a civil-law notary or lawyer.

If you do not agree with each other or if you have joint minor children, the same procedure applies as for a divorce.

The termination of a registered partnership is final if the agreement (of the lawyer or civil-law notary) or the decision (of the court) has been entered in the registers of the civil status where the registered partnership took place within three months.

Registration of divorce with the municipality

  • A written request for registration in the registers of civil status;
  • A copy of the divorce decree (court decision);
  • The deeds of acquiescence, which means that you do not appeal against the judge's decision;
  • Your valid ID.

Registration of termination of registered partnership with the municipality

Termination by court:

  • A written request for registration in the registers of civil status;
  • A copy of the court's decision;
  • If applicable: a statement from the court that no appeal has been lodged;
  • Your valid ID.

Termination by contract:

  • The declaration of termination of the registered partnership;
  • Your valid ID.

Your lawyer usually arranges the registration of your divorce/termination of a registered partnership. If you want to report the registration of the termination yourself, you can only contact us by appointment  .

A copy or extract of a civil status certificate costs € 15,70. 

A multilingual extract from a civil status certificate costs € 15,70.
