Registering a divorce in the civil registry in the Netherlands

Has a judge has agreed to your divorce (echtscheiding)? Then you and your partner will be sent a copy of the final order (echtscheidingsbeschikking). When does your divorce become final? Once you have registered the final order in the municipality’s civil registry (burgerlijke stand van de gemeente).

You can register the final order in the Register of Births, Deaths, Marriages and Civil Partnerships (burgerlijke stand van de gemeente). Do this at the municipality where you were married. This must be done within 6 months of the court ruling. When you have done this you are legally divorced.

  • a marriage or registered partnership can be dissolved by divorce or termination of partnership registration
  • your lawyer usually arranges for the registration of your divorce/termination of partnership registration

Registration of divorce with the municipality where the marriage was performed

Bring with you:

  • an original written request for registration in the register of civil status
  • original proof (order) of the court's ruling
  • the original deeds of resignation, this means that you do not appeal the court's decision
  • your valid identification

Registration of termination of registered partnership at the municipality where the partnership registration took place

In case of termination by the court:

  • original order of the court ruling
  • deed of resignation of both persons
  • original written request for registration in the register of civil status of 1 or both persons
  • your valid proof of identity

In case of termination by agreement:

  • the original declaration of termination of the registered partnership
  • your valid identity document

Divorce

A marriage can be dissolved by divorce. You must file for divorce with the court. For this you need a lawyer. After the court's ruling, the lawyer reports the divorce to the municipality where the marriage was consummated.

The divorce is final if the court's order is registered in the civil registry within 6 months of it becoming valid.

Termination of registered partnership

A registered partnership can be dissolved without the intervention of a judge. This is only possible if both partners agree and they have no joint minor children. The termination of a registered partnership is then done by an agreement at a notary or lawyer's office. In other cases, the procedure is the same as divorce.

The termination of a registered partnership is final when the agreement from the lawyer or notary (within 3 months) or the court order (within 6 months) is registered in the registers of the civil registry where the registered partnership took place.
