Applying for social assistance

If you have too little money to get by, you may be entitled to social assistance (bijstand). You can apply for social assistance at your municipality or the werk.nl website, an online work platform operated by the Uitvoeringsinstituut Werknemersverzekeringen – UWV (Employee Insurance Agency).

You are entitled to social assistance if you:

  • are a Dutch citizen or lawfully resident in the Netherlands, and;

  • are aged 18 or over;

  • do not have enough income or funds to get by. Your (joint) income must be below the social assistance standard (in Dutch);

  • cannot claim any other provision or benefit;

  • are not in prison or in a detention house.

There are also a number of obligations when you receive social assistance (in Dutch).

Applying for social assistance

Please note: you can only apply for bijstand (social assistance) if you live in the Netherlands and are registered with a municipality.

You can apply for a social assistance benefit from the municipality of Boekel if these additional conditions apply to you:

  • You are 18 years or older. You are Dutch or equivalent. 
  • You are equal to a Dutch national if you come from an EU country, Iceland, Liechtenstein, Norway, Iceland or Switzerland. You are also equated if you have a valid residence permit or if you legally reside in the Netherlands in some other way.
  • You live or stay in the Netherlands.
  • You have no or insufficient income of your own.
  • You have no assets or assets that are less than the maximum amount.  Your equity includes your savings, your car and your own home. Your equity may not exceed a certain amount.
  • You cannot receive any other benefit. For example, unemployment benefits or disability benefits.
  • You are not excluded from the right to social assistance benefits. This is the case, for example, if you are in prison.

You will find out within 8 weeks whether you will receive social assistance. You will receive social assistance from the date of the application.

Objection

If you do not agree with this decision, you can submit a notice of objection. You need to do this within six weeks from the date on which the decision was sent.

In the notice of objection you need to mention:

-       The date on which you write your notice;

-       Your name and address;

-       With which decision you disagree;

-       The reasons on which you disagree with the decision.

The notice of objection must bear you signature.

Submitting a notice of objection does not suspend the decision. This means the decision, against which you lodge a complaint, will have effect during the procedure of objection.

Urgent?

If you think the decision needs to be changed quickly to prevent irreversible consequences you can apply for provisional relief with the administrative court. This is an emergency procedure in which the judge can take measures to prevent irreversible consequences. To apply for provisional relief you need to pay a court fee. If you wish to apply for provisional relief you also need to send a letter to the preliminary relief judge of the Court ‘s-Hertogenbosch, Postbus 90125, 5200 MA ’s-Hertogenbosch.
