Applying for a planning permit

Are you planning to build or demolish something in your garden or next to your home? For example, do you intend to build a garage or cut down a tree? If so, you will often need a planning permit (omgevingsvergunning). You can apply for this permit via the Omgevingsloket. In some cases you only need to notify the authorities, and no permit is required.

You need a planning permit for various activities in your garden or in and around your house, such as: 

  • construction; 
  • demolition; 
  • building a driveway; 
  • modifying, renovating or restoring a listed building; 
  • cutting down trees. 

Go to the Omgevingsloket (online environment portal) to check whether you require a planning permit (in Dutch) or if just a notification is sufficient.

Announcements are public publications of decisions and rules that may be relevant to you. For example, environmental permits, traffic decisions, regulations and policy rules. We publish them on www.overheid.nl. You can also see the announcements each week on our noticeboard on the end of the municipal building, The announcements are also published each Wednesday for information in Actief. This weekly newsletter is free of charge and is delivered house-to-house within the municipality. Do you want to lodge an objection? Then you need to do the following:

·         For a standard environmental permit (8 weeks) you need to object within 6 weeks of publication of the decision. Instructions how to do this are included in the published decisions.

·         If it is an extended environmental permit (26 weeks), then it is a draft decision. You can submit your point of view within 6 weeks. This is followed by a definitive decision. You can submit an appeal to the court within 6 weeks. Send your letter to: [address]

Useful to know

You can only make a start once you have received the permit. If you start any earlier, then you will likely have to reverse all the work you did at your own expense.

If it turns out that you do need a permit or need to make a notification, then you can request a permit through the Environmental Portal(Environmental Portal online - Home page). Individuals need to log in using DigiD and companies using e-identification.

Applying for a permit

For demolition work and disposal of asbestos from your own property you do not normally need an environmental permit, but you do need to submit a notification. Check the prerequisites for demolition and disposal of asbestos at Demolition and disposal of asbestos - Smallingerland.

The charges will depend on which environmental permit you are applying for. You will be charged even if you do not obtain the permit. You can look up the charges for each permit Smallingerland municipality's Fees Regulation

The municipality will need 8 weeks (standard procedure) to assess your application. It will sometimes take 26 weeks (extended procedure). This will be the case, for example, if you want something different from what is stated in the bestemmingsplan (zoning plan). The municipality can extend the period once for a period of 6 weeks.
