Applying for a planning permit

Are you planning to build or demolish something in your garden or next to your home? For example, do you intend to build a garage or cut down a tree? If so, you will often need a planning permit (omgevingsvergunning). You can apply for this permit via the Omgevingsloket. In some cases you only need to notify the authorities, and no permit is required.

You need a planning permit for various activities in your garden or in and around your house, such as: 

  • construction; 
  • demolition; 
  • building a driveway; 
  • modifying, renovating or restoring a listed building; 
  • cutting down trees. 

Go to the Omgevingsloket (online environment portal) to check whether you require a planning permit (in Dutch) or if just a notification is sufficient.

Do you want to know whether you need an omgevingsvergunning (planning permit)? You can do an online vergunningcheck (permit check) at the Omgevingsloket online (planning permit online service desk) in Dutch.

Step 1: Make a (re)construction plan

Write down the basic principles of your plan for yourself: location and size, volume and surface dimensions, usage functions and the like. You can then use this information to find out what you need to arrange from the municipality, go to step 2.

Step 2: Preliminary consultation*

- The first thing you can do is do a permit check via omgevingsloket.nl. This allows you to check which permit you need to apply for.

- You then involve your environment in your concept plans.

- You can then submit a request for preliminary consultation (feasibility study) via omgevingsloket.nl. In this way, the municipality looks at your (re)construction plan from various fields and gives advice about your plans. In this phase you can still change your plans on the basis of this advice without incurring unnecessary costs and being tied to deadlines.

Step 3: Submit final application

You need DigiD to submit an online application. Don't have a DigiD? Then you can request a DigiD account via the DigiD website. A different login method applies to companies. They can log in via eHerkenning.

Apply for a permit online

If you want to apply for an environmental permit on paper, you can compile your application form via the environment counter. You can send the paper application to the municipality of Oldenzaal, PO Box 354, 7570 AJ, Oldenzaal. The forms service can help with filling in the form. To make a situation sketch, you can use the site: www.atlasvanoverijssel.nl and add this to the application.

The municipality assesses the application

The municipality first checks whether the application is complete. If this is not yet complete, you will still have the opportunity to complete the application. The municipality then checks whether the application is correct in terms of content. There is an average of 8 weeks between the submitted application and the permit granting (steps 3 and 4). Sometimes the municipality needs more time for an assessment. Then we extend the term.

Can the municipality grant a permit?

The municipality will inform you that it intends to reject your application. You may first respond to this in writing. The municipality assesses your response and then decides to issue the permit anyway or makes the decision to definitively refuse your application.

Step 4: Start work

You can appeal against the decision for another 6 weeks. The objection period starts the day after the decision is announced. If there is an objection, you will receive a message from us. You will not be notified if there are no objections. We advise you to wait a little longer than 6 weeks (due to possible objections by post) before you start building.

If your plan requires a permit, we advise you to submit a preliminary consultation on the environmental permit in a number of cases before making an official application. Based on a preliminary consultation, we assess whether your plan is feasible. For example, if it concerns a building plan, it will be tested against the zoning plan and your plan will be unofficially submitted to the City Architect (welstand) for the aesthetic aspects. We will inform you whether it makes sense to submit an application. This can be cheaper for you.

Request pre-consultation

You submit your preliminary consultation digitally via the environment counter. You must use DigiD or eHerkenning to submit your preliminary consultation digitally. This way we know that we are really dealing with you. You can request a DigiD account via the DigiD website. A different login method applies to companies. They can log in via eHerkenning.

This is how you apply for planning permission:

  1. Go to the Omgevingsloket online.
  2. Do the vergunningcheck.
  3. See whether you need a permit.
  4. You can apply for the permit immediately online or in writing. Use the Omgevingsloket for both options. Log in: 
    * for yourself: with DigiD 
    * for a company: with eHerkenning

A fee is payable for submitting an application for preliminary consultation. The costs for handling a preliminary consultation are € 150.00. If a final application is submitted within one year of completion of the preliminary consultation, the costs of the preliminary consultation will be deducted from the fees charged with the actual environmental permit application.

If a welfare test is required for the assessment of the preliminary consultation, the fees for the preliminary consultation will be increased by € 75.00. No settlement of this amount will take place afterwards. We aim to answer your request for consultation within 6 weeks.

The municipality will need 8 weeks (standard procedure) to assess your application. It will sometimes take 26 weeks (extended procedure). This will be the case, for example, if you want something different from what is stated in the bestemmingsplan (zoning plan). The municipality can extend the period once for a period of 6 weeks.

Do you disagree with the decision? If so, you can lodge a complaint. The following applies:

  • For a standard permit (8 weeks), you must lodge a complaint within 6 weeks of the decision being made and published. The conditions for lodging a complaint can be found on [link to municipality page] .
  • For an extended permit (26 weeks), the initial decision is a pending decision. You can submit your response within 6 weeks. After that a final decision will be issued. You can appeal to the rechtbank (district court) within 6 weeks. You can send your letter by post to: [Adres rechtbank]

Good to know

You may start work only once you have received the permit. If you start earlier, you may be required to undo the work at your own expense.
