Applying for a planning permit

Are you planning to build or demolish something in your garden or next to your home? For example, do you intend to build a garage or cut down a tree? If so, you will often need a planning permit (omgevingsvergunning). You can apply for this permit via the Omgevingsloket. In some cases you only need to notify the authorities, and no permit is required.

You need a planning permit for various activities in your garden or in and around your house, such as: 

  • construction; 
  • demolition; 
  • building a driveway; 
  • modifying, renovating or restoring a listed building; 
  • cutting down trees. 

Go to the Omgevingsloket (online environment portal) to check whether you require a planning permit (in Dutch) or if just a notification is sufficient.

Municipality of Midden-Delfland: Applying for a planning permit

Consult with the municipality in advance about your plans. Then you will not be faced with any surprises. This is called an exploratory interview. This is a first free consultation where you explain your ideas. And in which the municipality shares its points for attention and explains what the follow-up process looks like. When making your plans, contact the municipality as early as possible: via the general telephone number (015) 380 41 11 or by e-mail to bwt@middendelfland.nl to make an appointment. 

  • Do you want to know if you have to submit a notification or if you need an all-in-one permit for physical aspects (omgevingsvergunning)? You can do an online permit check on the online service counter (omgevingsloket in Dutch). 
  • Is it not entirely clear after a first meeting whether your initiative is permissible or promising? Then you can have an investigation carried out into the likelihood of success of your plan. To do this, you must submit a sketch plan
  • If you need a permit, you can apply for it via the Environment Desk online. Do this at least 8 weeks before you want to start the work. 
  • For an extensive application you must do this at least 6 months in advance. In the case of an extensive application, the municipality makes a draft decision on your application. This draft decision is not yet a final decision. Anyone can give his or her opinion on this draft decision within 6 weeks. This is called a view. Draft decisions that are available for inspection can be viewed on the Documents available for inspection page
  • If you do not agree with the draft decision, please state why in your opinion.
  • You will automatically receive a message whether you will receive the permit.

  1. Go to Omgevingsloket online (the online environment service counter, in Dutch).
  2. Run a permit check to see if you need a permit or if you must submit a notification.
  3. If you need a permit, you can apply for it at once online on Omgevingsloket or send in a written application. Log in with DigiD (for individuals) or eHerkenning (for businesses).
  4. If you have to submit a notification, you can do so at once on Omgevingsloket. Log in with DigiD (for individuals) or eHerkenning (for businesses).

The cost depends on which all-in-one permit for physical aspects you apply for. Note that you must pay even if your application is rejected. For the costs, see the rate table of the fee regulation, title 2, chapters 2 and 3

Did you submit a sketch plan prior to the final application for an environmental permit? In that case, we will deduct the fees for this sketch plan from the fees for processing the application for an environmental permit.

  • You will receive a message within 8 weeks whether you will receive the environmental permit. 
  • The municipality can extend this period once by 6 weeks. 
  • If the municipality does not decide within the term, you will receive the permit automatically. 
  • If you do not agree with the decision of the municipality, you can object within 6 weeks.

Extensive request

  • If you have submitted an extensive application, you will be notified within 6 months whether you will receive the environmental permit. 
  • This period can also be extended once by 6 weeks. 
  • If the municipality does not decide within the term, you will not automatically receive the permit. 
  • If you do not agree with the decision of the municipality, you can lodge an appeal with the court within 6 weeks. This is only possible if you have also submitted an opinion on the draft decision.

Do you want to object? In this case, the following rules apply.

  • For a standard all-in-one permit for physical aspects (8 weeks), you can file an objection within 6 weeks of the decision being published. How to do this is stated in the published decisions.
  • Does it concern an extended all-in-one permit for physical aspects (26 weeks)? Then it is issued a a draft decision. You can submit your opinion within 6 weeks. After that, a final decision will be made. You can appeal to the district court within 6 weeks.

Good to know

You must not start work until you have obtained the permit. If you start before that, you may have to undo the work at your own expense.
