Applying for a planning permit

Are you planning to build or demolish something in your garden or next to your home? For example, do you intend to build a garage or cut down a tree? If so, you will often need a planning permit (omgevingsvergunning). You can apply for this permit via the Omgevingsloket. In some cases you only need to notify the authorities, and no permit is required.

You need a planning permit for various activities in your garden or in and around your house, such as: 

  • construction; 
  • demolition; 
  • building a driveway; 
  • modifying, renovating or restoring a listed building; 
  • cutting down trees. 

Go to the Omgevingsloket (online environment portal) to check whether you require a planning permit (in Dutch) or if just a notification is sufficient.

Description

The environmental permit gives permission in the field of housing, space, the environment and nature. You may need an environmental permit for various activities. Among others for:

  • to build
  • demolish
  • chop trees
  • construct an entrance or exit
  • restore, rebuild or demolish a monument
  • advertise
  • fire-safe use of buildings

There are 2 procedures for granting an environmental permit. The normal procedure applies to an ordinary environmental permit. Does your permit application pose a major risk to the environment? Or is the municipality carrying out a nature assessment? Then the extended procedure applies. For example, with an environmental permit.

How to apply for an environmental permit:

  • Go to Milieuloket online.
  • Do the permit check.
  • You can see if you need a permit. You can apply for the permit immediately.

An environmental permit can have disadvantages for nature. This is because the conservation of protected areas, plant or animal species may be at risk. Please indicate this clearly in the application.

When you apply for an environmental permit, you usually do not only pay the costs for the environmental permit. Often the municipality also charges planning costs. These are costs for preparing and supervising the construction of facilities. For example, green areas, new roads or the filling of ditches. There is a calculation model with which the municipality determines the planning costs.

Ordinary procedure: you will receive the decision within 8 weeks. The municipality can extend this period once by 6 weeks.

Extensive procedure: you will receive the decision within 6 months. The municipality may extend this period by 6 weeks.

In a normal procedure you lodge an objection with the municipality. In an extensive procedure you give your opinion (opinion) about the draft decision.

Do this within 6 weeks. Do you disagree afterwards? Then you can appeal to the court. If necessary, you can still appeal.

Was there no response within the appeal period of 6 weeks? Then the permit is final.
